What is mediation?
We have all heard of mediation - its clear what the idea is in principle, however having a professional mediation experience improves the process in a number of ways. Its helpful to have a straightforward definition. Mediation is the facilitation of an effective conversation between disagreeing participants. In the vast majority of cases using a professional, neutral mediator leads to agreement between participants as to a satisfactory outcome to their shared issue and enables them to move forwards. Previously how this problem was being managed was causing companies and individuals huge amounts of stress, eye watering costs and taking up a disproportionate amount of time.
When is mediation helpful?
Ideally before you have pressed "go" on litigation, however in many instances mediation is used when the court process has started. Or in the case of workplace mediation before an employment tribunal. In commercial instances , judges are now often directing litigants to go to mediation and if that option isn't taken up (or is, but not taken seriously), even if a litigant wins a case, costs can be awarded against the winner because mediation has not been actively pursued. Small claims (below £10K) must now go to mediation.
OK so that might be the stick, but what about the carrot?
There are many reasons why mediation works and is a better option to a confrontational approach. Not least of these are the more creative opportunities that participants can agree to (options not available at court or at an employment tribunal). But for me an even more important reason is there can be a preservation and even transformation of relationships between the participants which leads to re-invigoration of their relationship - the raison d'etre for this new business - Symbioss.
